§ 13-41. Harbor property leases; statement of policy.

  • (a)

    All harbor property lease applications shall be made to the city manager on a form designed for that purpose, said application to be accompanied by a filing fee of one hundred dollars ($100.00) to cover the costs of obtaining a credit report, together with a cashier's or certified check made payable to the city covering the first six (6) months rental of the lease applied for. The city manager shall obtain a credit-character report on all applicants from a recognized agency, the cost of which is to be covered by the filing fee. The city manager shall submit said application, together with the credit report when received, to the city council together with his recommendation as to its disposition; providing further that the council will consider no application unless it is filed with the city manager in the proper manner at least ten (10) days in advance of the council meeting in which it is to be considered, provided that the said credit-character report has been furnished to the council.

    (b)

    The application and the lease shall specify the exact purpose for which the property is to be used, and stipulate that the property is to be used only for the exact purpose for which leased, and the city council alone will be the agency to approve such uses.

    (c)

    All leases shall provide for automatic cancellation in the event the property is not being put to the stated use within ninety (90) days after granting of the lease and continuously thereafter during the term of the lease.

    (d)

    All leases shall be granted for the primary term of five (5) years, with an option to enter into a new lease for an additional five (5) years at the then existing rental rate, except, however, when in the opinion of the council it is expedient to grant a lease for a longer primary term if and when the amount of investment warrants it.

    (e)

    Leases shall be assignable only by permission of the city council, and all assignments for the purpose of selling the improvements on the leased property shall be accompanied by an application for a new lease, said application to be acted upon by the council at the same time it acts on the request for permission to assign the lease.

    (f)

    All leases delinquent over thirty (30) days shall be terminated and canceled and lessee placed on a month-to-month tenancy pending the disposition of the delinquency.
